These Terms of Service ("Terms") govern your access to and use of services provided by sHosting("we," "us," or "our"), including our website, billing area, service panel, and any hosting-related products or services we provide.
By ordering, accessing, or using our services, you agree to these Terms. If you do not agree, do not use our services.
sHosting is an independently operated hosting service. We may offer services including, but not limited to, website hosting, VPS services, dedicated services, colocation, billing, support, and related infrastructure or management tools.
By using our services, you represent that:
You must notify us promptly if you become aware of unauthorized access, abuse, or a security incident involving your account or services.
Orders may be reviewed before activation. We may accept, reject, delay, suspend, or cancel an order if we reasonably believe it presents fraud, abuse, operational, legal, or security risk.
Provisioning times are estimates only unless explicitly stated otherwise. Service availability may vary due to maintenance, upstream issues, abuse handling, failures, or events outside our control.
Unless we explicitly state otherwise, our services are provided on an "as available" and "as is" basis.
Services ordered through our billing area may be subject to recurring billing. By purchasing a recurring service, you authorize us or our payment providers to charge the applicable fees for renewals unless the service is cancelled before the renewal date.
You agree that:
If a payment fails or is reversed, we may suspend affected services until payment is resolved.
Unless a specific service page, invoice, or separate written policy states otherwise, payments are non-refundable.
We may, at our sole discretion, issue a partial or full refund in limited situations, including duplicate payments, accidental charges, or cases where we determine a refund is appropriate.
Setup fees, custom work, one-time services, domain-related charges, third-party software licenses, and services already delivered or significantly consumed are generally non-refundable unless required by law.
You may not use our services for unlawful, abusive, harmful, or fraudulent activity. Prohibited uses include, but are not limited to:
We may investigate suspected abuse and take action without prior notice where necessary to protect our infrastructure, customers, or third parties.
You are solely responsible for the data, software, content, domains, applications, and activity associated with your services.
You are responsible for ensuring that you have the rights and permissions necessary to:
We do not pre-screen all customer content and are not responsible for content uploaded, stored, transmitted, or made available through customer services.
We may suspend, restrict, or terminate any service or account if:
In urgent cases, including abuse or active security incidents, we may suspend services immediately and without advance notice.
We may also terminate services for convenience or service discontinuation with reasonable notice where practical.
Unless we explicitly promise a backup service for a specific product, you are solely responsible for maintaining your own current and recoverable backups.
We are not liable for loss of data, corruption, deletion, failed backups, or restoration issues, regardless of cause.
We will make reasonable efforts to provide support for services we offer, but we do not guarantee any specific response time unless explicitly stated elsewhere.
Support is limited to the scope of the purchased service. We may decline support requests that are outside that scope, abusive, or unrelated to services we provide.
Our services may rely on or integrate with third-party software, infrastructure, payment processors, billing systems, control panels, analytics tools, or upstream providers. We are not responsible for the independent acts, outages, policy changes, or failures of third-party providers.
Your use of third-party services may also be subject to those providers' separate terms and policies.
To the maximum extent permitted by law, our services are provided without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability.
We do not guarantee that services will be uninterrupted, error-free, perfectly secure, or suitable for every use case.
To the maximum extent permitted by law, sHosting will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, business, goodwill, or data.
To the maximum extent permitted by law, our total liability arising out of or related to the services or these Terms will not exceed the amount you paid us for the affected service during the three (3) months immediately preceding the event giving rise to the claim.
You agree to defend, indemnify, and hold harmless sHosting from claims, damages, liabilities, losses, costs, and expenses, including reasonable legal fees, arising from or related to your use of the services, your content, your violation of these Terms, or your violation of any law or third-party right.
We may update these Terms from time to time. The updated version becomes effective when posted unless otherwise stated. Continued use of the services after an update becomes effective constitutes acceptance of the revised Terms.
If you have questions about these Terms, please contact us at info@shosting.tech.
